RE: The tariff classification of Nitrofurantoin Capsules USP (Macrocrystals), in dosage form, from India
Dear Ms. McIntyre:
In your letter dated September 25, 2015, you requested a tariff classification ruling.
The subject product, Nitrofurantoin Capsules USP (Macrocrystals) imported in 25 mg, 50 mg and 100 mg, is a medicinal preparation containing Nitrofurantoin, an antibacterial agent, as the active ingredient. It is indicated for the treatment of specific urinary tract infections.
The applicable subheading for the Nitrofurantoin Capsules USP (Macrocrystals) in dosage form, will be 3004.90.110, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses … or in forms or packings for retail sale: Other: Other: Other: Anti-infective medicaments: Other.” The rate of duty will be free.
